1. Agreement to Terms

Welcome to The Yuma Project. These Terms of Service ("Terms") govern your use of our website at theyumaproject.com (the "Site") and your purchase of products from Maryhems Inc, doing business as Yuma ("Yuma," "we," "us," or "our").

By accessing our Site, making a purchase, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

We will notify users of material changes via email (if provided) or through a prominent notice on our Site.

3. Eligibility and Account Creation

Eligibility

Our services are available to individuals of all ages. However, if you are under 18, you represent that you have parental or guardian consent to use our services and make purchases.

Account Creation

You may create an account to facilitate purchases and track orders. When creating an account, you agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information as needed

  • Keep your password secure and confidential

  • Notify us immediately of any unauthorized use of your account

  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Products and Pricing

Product Descriptions

We strive to accurately describe and display our products. However, we do not warrant that product descriptions, colors, images, or other content on the Site are completely accurate, current, or error-free.

All products feature original designs created by The Yuma Project and are protected by copyright and trademark laws.

Made-to-Order

Our products are made-to-order, meaning each item is created specifically for you after you place your order. This approach:

  • Minimizes waste and supports sustainability

  • Ensures quality and attention to detail

  • Requires 1-3 business days for production before shipping

Because items are made-to-order, cancellations are only possible before production begins, typically within 1-2 hours of purchase (see Section 8).

Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price you pay is the price displayed at the time you complete your purchase.

Prices do not include applicable taxes or shipping fees, which will be calculated and added at checkout.

Availability

We reserve the right to:

  • Limit quantities of any products

  • Discontinue any product at any time

  • Refuse or cancel orders that appear fraudulent or violate these Terms

If we cannot fulfill your order, we will notify you and issue a full refund.

5. Payment

Accepted Payment Methods

We accept the following payment methods:

  • Major credit cards (Visa, MasterCard, American Express)

  • Debit cards

  • Apple Pay

  • Google Pay

  • PayPal

  • Shop Pay Installments

Payment Processing

Payment is processed at the time you place your order. By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method

  • The information you provide is accurate and current

  • You will pay all charges incurred

We use third-party payment processors to handle transactions securely. We do not store your complete credit card information.

Sales Tax

We collect applicable sales tax as required by law based on your shipping address. Tax amounts are calculated at checkout.

6. Shipping and Delivery

Shipping Timeline

  • Processing: 1-3 business days (made-to-order production)

  • Shipping: 3-7 business days (standard shipping)

  • Total Timeline: Approximately 1-2 weeks from order to delivery

Shipping Locations

We currently ship within the United States only. International shipping may be considered on a case-by-case basis - contact us at yuma@theyumaproject.com if you are located outside the US.

Tracking

You will receive a tracking number via email once your order ships. You are responsible for providing an accurate shipping address.

Risk of Loss

All items purchased from The Yuma Project are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier.

Shipping Delays

While we strive to meet our stated timelines, we are not responsible for delays caused by:

  • Carrier delays

  • Weather or natural disasters

  • Customs issues (international orders)

  • Incorrect shipping addresses provided by you

  • Other circumstances beyond our reasonable control

7. Returns, Exchanges, and Refunds

Return Policy

We accept returns within 14 days of delivery for unworn, unwashed items in original condition with all tags attached.

To initiate a return:

  1. Email us at yuma@theyumaproject.com with your order number

  2. Receive return authorization and instructions

  3. Ship the item back at your expense

  4. Receive store credit within 3-5 business days after we receive and inspect the return

Important:

  • You are responsible for return shipping costs

  • Returns are issued as store credit, not refunds to your original payment method

  • Items must be in resalable condition

Damaged, Defective, or Incorrect Items

If your order arrives damaged, defective, or incorrect:

  • Contact us within 7 days of delivery

  • Provide photos of the issue

  • We will replace the item at no cost to you

We stand behind the quality of our products and will make it right.

Exchanges

We do not offer direct exchanges. To exchange an item for a different size or product, please return the original item for store credit and place a new order.

Non-Returnable Items

Due to our made-to-order model, we do not accept returns for:

  • Items that have been worn, washed, or altered

  • Items returned after 14 days

  • Items without authorization

Missing Items

If part of your order is missing, contact us immediately at yuma@theyumaproject.com with your order number. We will resolve the issue promptly.

8. Order Cancellations

Cancellation Window

Orders enter production quickly, typically within 1-2 hours of purchase. Cancellations are only possible if your order has not yet been submitted to production.

To request a cancellation, contact us immediately at yuma@theyumaproject.com with your order number. We cannot guarantee cancellation once production has begun.

Our Right to Cancel

We reserve the right to cancel any order at our discretion, including orders that:

  • Appear fraudulent or unauthorized

  • Violate these Terms

  • Cannot be fulfilled due to product unavailability

  • Contain pricing or product errors

If we cancel your order, we will issue a full refund to your original payment method.

9. Intellectual Property Rights

Our Intellectual Property

All content on the Site, including but not limited to:

  • Product designs and artwork

  • Text, graphics, logos, and images

  • Website design and layout

  • The Yuma Project name and branding

  • Product names and descriptions

is the exclusive property of Maryhems Inc (d/b/a Yuma) and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

All designs are original creations by The Yuma Project and our Palestinian artists and designers.

Trademarks

"Yuma," "The Yuma Project," and our logos are trademarks or common law trademarks of Maryhems Inc. You may not use these trademarks without our prior written permission.

License to Use Site

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not include:

  • Resale or commercial use of the Site or its contents

  • Collection and use of product listings or descriptions

  • Derivative use of the Site or its contents

  • Downloading or copying account information

  • Use of data mining, robots, or similar data gathering tools

Restrictions

You may not:

  • Copy, reproduce, modify, or create derivative works from our designs or content

  • Distribute, sell, or commercially exploit our intellectual property

  • Remove or alter any copyright, trademark, or proprietary notices

  • Use our intellectual property in any way that suggests endorsement or association without permission

  • Reverse engineer, decompile, or disassemble any portion of the Site

10. Prohibited Uses

You agree not to use the Site or our services to:

Illegal Activities

  • Violate any local, state, national, or international law

  • Engage in fraudulent transactions or payment disputes

  • Use stolen payment methods or personal information

Harmful Conduct

  • Harass, threaten, or harm others

  • Post or transmit hate speech, discriminatory content, or violent material

  • Impersonate any person or entity

  • Interfere with or disrupt the Site or servers

Unauthorized Commercial Use

  • Create counterfeit or knock-off versions of our designs

  • Use our product images or descriptions for your own commercial purposes

Technical Violations

  • Attempt to gain unauthorized access to the Site, accounts, or systems

  • Use any automated system (bots, scrapers, etc.) to access the Site

  • Transmit viruses, malware, or harmful code

  • Overload or interfere with Site functionality

Intellectual Property Violations

  • Copy, reproduce, or distribute our designs or content without permission

  • Use our trademarks or branding without authorization

  • Create derivative works based on our designs

Violation of these prohibitions may result in termination of your account and legal action.

11. User-Generated Content

If we enable features that allow you to submit content (such as reviews, photos, or testimonials), you agree that:

Content Standards

You will not submit content that:

  • Is false, misleading, or defamatory

  • Contains hate speech or discriminatory material

  • Infringes on intellectual property rights

  • Contains personal information about others

  • Violates any law or these Terms

License to Use Your Content

By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, and display your content in connection with our business, including for marketing purposes.

No Obligation

We have no obligation to monitor, display, or review user content, and we reserve the right to remove any content at our discretion.

Responsibility

You are solely responsible for any content you submit. We are not liable for user-generated content.

12. Disclaimers and Limitation of Liability

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE YUMA PROJECT AND ITS PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR COMPLETENESS OF CONTENT

  • UNINTERRUPTED OR ERROR-FREE SERVICE

We do not warrant that:

  • The Site will be available at all times or without interruptions

  • Defects will be corrected

  • The Site is free of viruses or harmful components

  • Products will meet your specific expectations beyond our stated return policy

Product Warranty Disclaimer

While we stand behind the quality of our products and will address legitimate defects or damage as outlined in Section 7, we do not provide any formal warranty beyond our return and exchange policy.

Normal wear and tear, fading, shrinkage, or damage resulting from misuse, neglect, accidents, or failure to follow care instructions are not covered.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MARYHEMS INC (D/B/A YUMA) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data

  • Business interruption

  • Personal injury or property damage

  • Cost of substitute goods or services

ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT(S) AT ISSUE, OR $100, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Maryhems Inc (d/b/a Yuma), its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Site or products

  • Your violation of these Terms

  • Your violation of any rights of another person or entity

  • Your violation of any law or regulation

  • Any content you submit to the Site

14. Dispute Resolution and Governing Law

Governing Law

These Terms and any disputes arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Cook County, Illinois. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Informal Resolution

Before filing any legal claim, you agree to first contact us at yuma@theyumaproject.com to attempt to resolve the dispute informally. We will do our best to resolve issues directly with you.

Time Limitation

Any claim or cause of action arising out of or related to your use of the Site or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be forever barred.

15. Third-Party Services

Our Site may contain links to third-party websites, services, or resources, including:

  • Payment processors

  • Shipping carriers

  • Social media platforms

  • Other external websites

We are not responsible for:

  • The content, accuracy, or practices of third-party sites

21. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms to any successor in interest in connection with a merger, acquisition, or sale of assets.

22. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, pandemics, etc.)

  • War, terrorism, or civil unrest

  • Government actions or restrictions

  • Labor disputes or strikes

  • Utility or telecommunications failures

  • Supplier or carrier delays

23. Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.
